CONTEST BEGINS July 26, 2011 AT 12:00:01 AM ET AND
ENDS AT 11:59:59 PM ET September 11, 2011.
ELIGIBILITY: Red Robin's THE PEOPLE'S BURGER Contest ("Contest") is open to Entrants who, as of the Contest start date, are eighteen (18) years of age or older and legal residents of the fifty (50) United States or the District of Columbia ("U.S.") except where prohibited. Contest Judges and their family members and Family members of employees and children residing with employees, officers and directors of Red Robin International, Inc. ("Sponsor"), Sponsor's parent, subsidiaries, franchisees or affiliates and the advertising or promotion agencies of each are not eligible to enter or win this Contest. Prize winners of contests and sweepstakes hosted by Red Robin International, Inc. in the last twelve months are not eligible to enter or win this Contest.

The Contest begins on July 26, 2011 at 12:00:01 a.m. Eastern Time (ET) and ends on September 11, 2011 at 11:59:59 p.m. ET ("Promotion Period"). Sponsor's clock shall be the official clock of the Contest.
Limit: one (1) entry per person. All entries submitted become the property of the Sponsor. Entries will not be acknowledged or returned. Any entry obtained or submitted outside authorized, legitimate channels, or not in compliance with these Official Rules, will be void. Multiple entries from the same Entrant and/or duplicate entries will be void. By entering the Contest, each Entrant agrees to be bound by the Official Rules, copies of which are available at www.thepeoplesburger.com.
ENTRY QUALIFIERS: WINNER SELECTION/JUDGING CRITERIA:
Entries will be judged on the following criteria:
ENTRY QUALIFIERS: Each Entrant certifies by entering the Contest that he/she has the right, and authorizes Sponsor, to publish the entry (or portions thereof as edited or selected at Sponsor's discretion) in print, audio, video, Internet or other media and to use the ideas encompassed in the entry in perpetuity, without compensation, unless required by law.
GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor also reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
DISPUTES: Any dispute relating to the Contest (including, without limitation, a dispute as to whether an Entrant has complied with all of these Official Rules) shall be resolved by the Sponsor, in its sole and absolute discretion, and the decision of the Sponsor shall prevail. All decisions of the Sponsor shall be final. Additionally, and except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts of Colorado; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Colorado, without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than Colorado.
PRIZES: One Entrant's Burger will be selected as the People's Burger. (One (1) "Grand Prize Winner" or "Winning Entrant") and the Grand Prize Winner will receive one (1) year of Red Robin YUMMM® (12 gift cards valued at $30 per card), an Apple® iPad2 ($500 value) and a party at the nearest Red Robin® restaurant to Grand Prize Winner's home for the Grand Prize Winner and 25 guests where the winning burger will be served (up to a $500 value). Any travel required to reach the selected Red Robin® restaurant will be the responsibility of Grand Prize Winner and their guests.
Two (2) runners up prizes will be awarded. Both runners up will receive one (1) year of Red Robin YUMMM® (12 gift cards valued at $30 per card)
Estimated Retail Value ("ERV") of the prize package is $2,080. Winning Entrants are responsible for paying all applicable local, county, state and federal taxes on the prize they win based on the actual retail value of the prize, as set forth in the contest rules, and may be issued an IRS 1099 form for all prizes won from Sponsor where the aggregate value of all prizes is $600 or more in any calendar year. Sponsor will not award any difference between estimated and actual value of prize.
Odds of winning depend on the number of eligible entries received during the Promotion Period.
JUDGING: Judges include Red Robin Executive Chef Dave Woolley, the 2011 Red Robin® Chief Burger Officer Contest Winner Michael Morrison, 2010 Red Robin® Kids' Cook-Off Grand Prize Winner Donovan Duggins, and the Red Robin Marketing Team. Judging will take place from 9/12/11-9/21/11.
WINNER NOTIFICATION/RELEASES: Sponsor will attempt to notify the Grand Prize Winner via email or U.S. mail on or about September 21, 2011. Entrant will be required to complete, sign, have notarized and return within 3 days of receipt (a scanned copy will be sufficient) an affidavit of eligibility, a licensing agreement, a waiver of liability and, where permitted, publicity release for themselves. Failure to return such documents within the designated time period may result in Grand Prize Winner forfeiting any prize they may have otherwise been eligible to receive. Any prize or prize notification returned as undeliverable or refused will result in disqualification of Entrant, and Sponsor may name an alternate winner. By accepting a prize, the Entrant consents (where legal) to the use of the Entrant's name, likeness, photograph, biographical information and statements by Sponsor and its parent, subsidiaries, franchisees or affiliates for purposes of advertising, promotion and publicity without notice or compensation, except as required by law.
LIMITATION ON LIABILITY: Each Entrant agrees to release, discharge, indemnify and hold harmless Sponsor, its parent, subsidiaries, franchisees, affiliates or advertising or promotion agencies and their respective officers, directors and employees, representatives and agents from and against any claims, damages or liability due to any injuries, damage or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity (including but not limited to travel related thereto) or participation in the Contest. Sponsor is not responsible for any telephone, computer or network malfunction or error, or for computer viruses or damage caused to Entrant's computer from accessing the Contest web site. If Sponsor cannot run this Contest as planned due to any cause beyond the reasonable control of Sponsor that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor may cancel, terminate, modify or suspend that portion of the Contest. If Sponsor terminates the Contest prior to its scheduled end date, Sponsor will determine a winner from all eligible entries received as of the termination date and will post notice of such termination at www.redrobin. Sponsor is not responsible for any typographical or other printing errors in the offer or administration of the Contest, including, but not limited to, errors in the printing or posting of the offer or in these Official Rules, the selection or announcement of the winner or the distribution of any prizes.
